The short version. Thyft helps a workplace build a schedule and lets its team see it, ask for time off and swap shifts. It is a planning tool, not a timeclock and not a payroll system, and it is not a record of hours worked. The business that sets up a workplace is our customer and is responsible for what it puts in and for following its own employment laws.

1. Who this agreement is between

These terms are between Thyft, operated by Thiago Litzkow of Florida, United States ("Thyft", "we"), and the business that creates a workplace in the service ("you", "the Customer").

People invited into a workplace — managers and staff — use Thyft under the Customer's account. They are not our customers, and the Customer remains responsible for them.

2. What Thyft does

Thyft lets a workplace build and publish a shift schedule, record who is available, handle requests for time off, let people swap shifts with each other, print a daily list, and send notices to the team.

What Thyft is not. Thyft is not a timeclock and does not record hours actually worked. It is not a payroll system and does not calculate pay. It does not decide whether a schedule complies with employment law, overtime rules, break requirements, predictive scheduling ordinances, or minor labour rules.

What the app shows is a plan. What actually happened on the floor is the Customer's record to keep.

Everything you put into Thyft stays yours. We do not claim ownership of it, we do not sell it, and we do not use it to train anything.

We hold it to run the service for you, as described in our Privacy Policy. You can ask for a copy or for deletion at any time.

You are responsible for having the right to put people's information into Thyft, and for whatever notice or consent your local law requires from them.

6. Rules of use

Do not use Thyft to break the law, to harass anyone, to send unsolicited messages, to store information you have no right to hold, or to attack or overload the service. Do not resell it or pass it off as your own.

We can suspend a workplace that does any of these, and will tell you why.

7. Uptime, and when things go wrong

We work to keep Thyft available, but we do not promise it will never be down. We do not promise it is free of faults.

We keep backups, but you should not treat Thyft as your only copy of anything you cannot afford to lose. Print or export what matters to you.

8. Limits on what we owe you

Thyft is provided as it is. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including fitness for a particular purpose.

We are not liable for indirect, incidental or consequential losses — including lost profit, lost business or the cost of covering a shift.

Where we are liable, our total liability for any claim is limited to what you paid us in the twelve months before the claim arose.

Some places do not allow these limits. Where that is so, they apply only as far as the law permits.

9. Employment law is yours

You decide who works when. Thyft only records that decision. Overtime, breaks, minimum rest, predictive scheduling notice, rules about minors, and everything else in your local employment law remain entirely your responsibility.

If you use a schedule from Thyft in a dispute, an audit or a claim, you do so on your own judgment about whether it shows what you need it to show.

10. Ending it

You can stop using Thyft at any time and delete your workplace from the app.

We can end this agreement with 30 days' notice, or immediately if you break these terms in a way that is serious or repeated. If we end it for our own reasons, we will refund the unused part of what you paid.

After it ends, we delete your data within 60 days unless you ask us to do it sooner.

11. Changes to these terms

If these terms change in a way that matters, we will tell you at least 30 days before it takes effect. Carrying on using Thyft after that means you accept the new terms. If you do not, you can cancel and we will refund the unused part.

12. Using Thyft outside the United States

Thyft is sold worldwide. Wherever you are, the following apply.

13. Which law, and where disputes go

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Disputes go to the state or federal courts located in Florida, and both sides agree to that.

If you are a business in the European Economic Area or the United Kingdom, this choice of court does not remove any right you have under your own law to bring proceedings where mandatory rules say you may.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Before filing anything, both sides agree to spend 30 days trying to sort it out directly, in writing.
